Federal-state battle looms for Selangor’s water assets

KUALA LUMPUR, Feb 27 — Malaysianinsider — Business Times Singapore

A battle appears to be looming between the federal government and the state government of Selangor over the takeover of privatised water concessions in the state. At stake are billions of ringgit for the concessionaires and higher water tariffs for consumers.

The move to restructure the sector could also become a political flash point with the Pakatan Rakyat accusing the Barisan Nasional of bailing out its cronies to the detriment of the public.

In spite of its own designs to consolidate the sector, the central government had “gone off on its own tangent”, rather than work with the state, a panel set up for the reorganisation exercise said yesterday.

This “sabotage” occurred when a central government agency — which had agreed to state-led talks earlier — inexplicably announced on Feb 18 that it would take over the negotiations and deal directly with the concessionaries.

This about-turn came two days before a deadline for the companies to accept an offer by the state of RM4.6 billion for their assets (treatment plants and pipes), and another RM1.1 billion for their equity.

The offer was subsequently rejected by the four concessionaires — Puncak Niaga (M) Sdn Bhd, Syarikat Pengeluar Air Selangor Holdings Bhd (Splash), Konsortium Abass Sdn Bhd and Syarikat Bekalan Air Selangor Sdn Bhd (Syabas) — in the belief that the federal government would revert with a more attractive option.

At a press conference yesterday, panel member and parliamentary lawmaker Tony Pua said that being a regulated industry, Selangor was prepared to give the companies 12 per cent return on capital annually starting from the concession period.

“We are not nationalising at zero cost. But they have excessively leveraged their assets and have problems paying off their loans, and now expect the state to help out.”

Together, the four players have total debts of RM6.4 billion, mainly in outstanding bonds, the net debts of Puncak Niaga and Syabas — both controlled by businessman Rozali Ismail — amounting to some RM4.2 billion.

While the state holds a stake in the concessionaires through its agencies, their shareholders include Puncak Niaga Holdings and Gamuda Bhd — listed companies which minorities bought into on the strength of earnings from their concessions. In turn, the companies have returned cash amounting to hundreds of millions of ringgit to shareholders over the years.

Pointing to major breaches of concession terms by Syabas, the panel questioned why the federal government had seen fit not to take action.

Malaysia saw a wave of privatisation projects in the 1990s, but as with highway and power concessions, the current issue with water concessionaires is now a sore point as terms and conditions become known.

The federal government has come under fire for the lop-sided agreements favouring concessionaires. But varying the terms now or buying over the assets could spook investors if it were not properly managed.

The panel gave an assurance that water tariffs could be lowered beyond the current 77 sen per cubic metre for domestic users if it were to handle the takeover.

Associate professor at Nottingham University Subramaniam Pillay observed that the state owned 70-80 per cent of all water assets and the federal government's plan to take over the assets and capital expenditure and to license the distributors goes against the plan of having a central body manage the whole system.

To break the legal impasse over who ultimately calls the shots, Consumers Association of Subang & Shah Alam president Datuk Jacob George suggested that the state seek a legal remedy “as the issue has significant implications for Selangor and the rest of the states”.

Pas calls for a unity government

In another sign that Pas has yet to abandon the idea of forging a closer relationship with Umno, the Islamist party's president Datuk Seri Hadi Awang has called for the formation of a national unity government in view of the current political turmoil.

In an interview with The Malaysian Insider, the Marang MP said Barisan Nasional could not on its own bring the country out of the economic crisis.

Hadi was also certain that the party would not suffer the same fate as in 1970s when it was expelled from BN and lost its control over Kelantan.

Last year, the party was split between the conservative faction which favours cooperation with Umno through what it calls muzakarah (dialogue) and another which prefers to strengthen the then newly formed alliance Pakatan Rakyat.

“We need to look common ground in uniting political parties in carrying out responsibilities, it’s not that we cannot disagree, but we want this common ground to be given priority, before we spend our time on issues that we disagree on,” said Hadi.

He added that he was inspired by the efforts taken by former Indonesian president BJ Habibie who united and reformed the country after the end of Suharto’s era.

“Most importantly, the people must be united. It has to take precedence over party interest. Let us sacrifice some of our rights sincerely for the sake of saving our country,” said Hadi.

“I wish to suggest to the outgoing Prime Minister to make some changes, to at least complete his agenda in reforming the judiciary, eradicating corruption and I believe Barisan Nasional cannot do it alone.

"To do it fairly it must involve all parties, in times of crisis it is important for all of to carry out our duties collectively,” said Hadi.

He confirmed that while the matter has been discussed internally it has yet to be brought to the Pakatan Rakyat leadership council of which Hadi is a member.

“This is a very big thing. Even at party level, we have yet to discuss in detail but I could see that many agreed with me in principle, but the execution will not be easy.

"It takes time, the right attitude, and openness from all parties and a sense of responsibility,” said Hadi.

“We have discussed many options in restoring the nation’s political stability. Pas is very experienced. We have joined a coalition government and Pas was also part of Barisan Nasional and we have to enrich our experience, by taking the responsibility of solving our country’s problems,” he added.

He also said that the party has yet to contact any BN leader on his idea.

Hadi added that the idea of forging political cooperation must be seen in a wider context.

“In handling national issues, we are allowed to tahaluf (forming alliance) with any party. Tahaluf not only in the context of opposition parties but in the context of governing the nation, and without us joining BN or BN joining us,” he said.

“I have floated this idea in Selangor at a victory celebration after the general election at Melawati Stadium, but at the time BN wanted to defend their position and Pakatan Rakyat wanted to bring about change its own way,” he added.

Hadi said that with the current economic crisis and political turmoil the time is right for a unity government.

Spat with Anwar has ended, says Karpal

AFTER challenging Opposition Leader Datuk Seri Anwar Ibrahim openly for weeks over issues surrounding party hopping, Karpal Singh said he accepted the former as head of Pakatan Rakyat.


Karpal Singh told the Dewan that there was no more misunderstanding between the Opposition leader and him.

“Any misunderstanding was between us, and is none of Barisan Nasional’s business,” he said during his debate on the motion of thanks on the Royal Address.

Karpal Singh also said the 100 police reports made against him recently were vicious.

“Tuan Speaker, this must be a world record – 100 reports, two bullets,” he said, adding: “Under the Internal Security Act, it is mandatory death sentence for a person who sends even one bullet.”

“I want to know how Umno Youth got the bullets and sent them to me?” he said.

Datuk Abd Rahman Dahlan (BN – Kota Belud) retorted: “How can you say it’s Umno Youth? Do you have the proof?”

Datuk Ismail Mohamed Said (BN – Kuala Krau) said Karpal Singh should retract the allegation.

Urged by Deputy Speaker Datuk Wan Junaidi Tuanku Jaafar, Karpal Singh retracted the word “celaka” he used when he accused the wing.

Jangan main-main dengan saya (Don’t play with me). Don’t forget that King is Singh and Singh is King,” he said, in obvious reference to a popular Bollywood movie with the same catchline.

Last week, Karpal Singh received live bullets and a death threat through the mail at his home in Penang. A note told Karpal Singh to not fool around with Malay rulers.

Three out of four persons being investigated in relation to the infamous V. K. Lingam video clip case, have been cleared of graft charges, the prime minister told Parliament today.

Datuk Seri Abdullah Badawi told Wee Choo Keong (PKR-Wangsa Maju) in a written reply that the three cases had been marked “NFA” — which means no further action will be taken.

The file on one of the four persons originally investigated remain open. The PM did not name any of the four persons.

Abdullah said there was insufficient evidence to charge the three persons under the Anti-Corruption Act 1997.

The Lingam video clip was widely circulated on the Internet in 2007.

In the grainy clip, Lingam is recorded having a telephone conversation apparently with a minister and appears to be brokering judicial appointments.

The video clip which was recorded by Loh Gwo Burne, who is now the PKR MP for Kelana Jaya, sparked a major public outcry.

A Royal Commission was set up to investigate the videp clip but the findings were inconclusive regarding Lingam’s role in any alleged brokering of judicial appointment.

During the hearing, Lingam famously said “it looks like me, it sounds like me,” when questioned if he was indeed the man in the clip.

The V. K. Lingam video clip scandal was a significant contributing factor towards the Barisan Nasional (BN) government’s poor performance in last year’s general elections.

Four investigation files were opened by anti-corruption officers, the prime minister said in Parliament today.

Three of the cases were “deferred” to the Attorney-General’s Chambers, while one was marked “NFA” by the director of the legal and prosecution department in the Malaysian Anti-Corruption Commission.

Of the three cases “deferred” to the Attorney-General’s Chambers, two were marked “NFA” while the remaining case remains open.

Wee told reporters later that the director of the legal and prosecution department did not have the power to decide on a case but to only investigate.

“This is unheard of and first time as a lawyer. Why are they taking so long? The last time they said that the paper has already been sent but now they say it is for further investigation,” he said.

More irregularities at Permodalan Negeri Selangor Bhd are expected to be uncovered by auditors and will be disclosed to the press as they emerge.

Selangor Menteri Besar Tan Sri Khalid Ibrahim said today external auditors have yet to complete auditing the accounts of the state investment arm and told reporters that it was premature for them to lodge any reports with the Malaysian Anti-Corruption Commission (MACC).

“We are more professional than some other agencies and we will only take the necessary action after our probe is completed,” said Khalid, who was answering a question about yesterday’s revelations that senior PNSB officials were being probed for allowing unauthorised purchases and sales of apartments in Mecca.

Speaking after the weekly state exco meeting, he said the move had exposed PNSB to risk and there were elements of non-reporting to Bank Negara.

Khalid refused to comment when asked if the move amounted to Criminal Breach of Trust (CBT) and added that the MACC would have to determine that.

On comments from Datuk Seri Dr Mohd Khir Toyo, who is the former PNSB chairman, that there were no losses in the transactions, Khalid said his predecessor was entitled to his opinions.

Khalid declined to name the individual who benefited from the deal.

On Monday, PNSB chief executive officer Datin Khairiyah bu Hassan and finance manager Nora Azmin Radzuan were told to go on leave after auditors found discrepancies in the company accounts including the purchase and sale of properties in Saudi Arabia.

Perak Speaker deems MACC probe an insult

Perak State Assembly Speaker V. Sivakumar said today he deemed the Malaysian Anti-Corruption Agency (MACC) probe on him for suspending Menteri Besar Datuk Dr Zambry Abdul Kadir and six of his executive councillors from attending state assembly sittings, as an insult.

“I consider this an insult to the legislature, but nevertheless, I gave my full cooperation in the probe,” he told reporters after being interviewed by two MACC officers from Putrajaya at the Menteri Besar’s official residence here today.

He added that he could not understand the need for his being questioned when he was only discharging his duties and the whole episode seemed more like “harassment” and an affront to the doctrine of separation of powers in a democracy.

Yesterday, he was interviewed by police at his law office here over the same matter.

The probes came in the wake of reports lodged against him with the police and the MACC over his action in the suspensions of Zambry and the excos.

Gerak congratulates MACC chief

Gerak, the organisation that is crusading against corruption, today congratulated Malaysian Anti-Corruption Commission (MACC) chief Datuk Seri Ahmad Said Hamdan for his bravery in revealing the corruption investigation on Selangor Menteri Besar, Tan Sri Abdul Khalid Ibrahim.

“We congratulate Ahmad said and hope the MACC will continue to act without fear or favour in discharging its duties,” Gerak chairman Mohd Nazree Mohd Yunus told Bernama when asked for his reaction on Ahmad Said revealing the matter.

Ahmad Said, at a press conference in Penang last week, had said the MACC had strong evidence to act against Khalid for alleged corruption.

Mohd Nazree said Gerak would not waver in its crusade in exposing the corrupt no matter who they were.

Gerak had made the complaint to the MACC that Khalid had allegedly abused his powers in purchasing cows as a donation for the Aidiladha celebration in his Bandar Tun Razak parliamentary constituency and misusing state funds for the maintenance of his personal car.

DAP unveils plan to make NSE toll-free by 2016

Pakatan Rakyat partner DAP has unveiled a proposal that can make the North South Expressway toll free by 2016.

DAP’s Restructure Toll Rates and Equity team - codenamed Restore - has called on called on Finance Minister Najib Abdul Razak and Works Minister Mohd Zin Mohamed to study the proposal and include the plan under the mini-budget due to be tabled on March 10.

“It is a very creative proposal, we strongly we believe that it would work. It doesn’t cost the government anything and it brings tremendous amount of benefits for all Malaysians,” said Petaling Jaya Utara MP Tony Pua.

“We call upon the Finance Minister to work together with the Works Minister to make this proposal a reality because it brings a lot of benefits, not just to normal road users, but what it actually creates for the economy is enormous.”

Buyng over PLUS for RM13.75 bln, funding with MGS

DAP Restore believes that the government can buy over concessionaire PLUS Expressways Bhd through issuance of government bonds, which can be repaid by toll collection within six years.

PLUS, in which state investment arm Khazanah has a 65 per cent stake in, also operates ELITE, Butterworth-Kulim (BKE) and the Second Link highways.

DAP’s plan centres around the government making a general offer to acquire all minority shareholders of PLUS with 15 per cent premium at RM3.30 per share.

Such an offer is considered generous as PLUS was listed on Bursa Malaysia at a price of RM2.88 per share, said Teh Chi-Chang, economic advisor to DAP secretary-general Lim Guan Eng.

The payout for this share offer would amount to RM5.2 billion, and ensure that minority shareholders are protected. Added to the RM8.5 billion net debt of PLUS, the total cost of acquisition would amount to RM13.75 billion.

Teh said this could be funded by issuing Malaysian Government Securities at 3 percent interest per annum, costing RM413 million in annual interest. Total repayment would amount to RM16.2 billion over six years.

Meanwhile, PLUS would also be generating at least RM20 billion in net positive cash flow in the six years to 2015 - even without further toll rate hikes. Therefore, the government would be able to repay the MGS and still have excess cash of RM3.8 billion, he added.

Saving billions of ringgit and making it easier for businesses

Teh said under the DAP plan, Malaysian taxpayers would not be burdened by additional costs and the expressways would be restricted to collecting tolls to only up till 2015.

Pua also said the RM4 billion saved by Malaysian consumers would reduce the cost of living for the average rakyat during the current economic turmoil.

“The billions saved can also be redirected to other more productive sectors of the economy. The abolishment of the toll rates can substantially reduce the cost of doing business in Malaysia and increase logistical efficiencies.

“This will increase the competitiveness and efficiency of Malaysian companies in the midst of an economic crisis where it is critical for us to support the people,” Pua said.



BN Has Lost Support, Says Razaleigh

Umno maverick lawmaker, Tengku Razaleigh Hamzah, continues to be a thorn to his party by taking a swipe at the three contenders for the Umno Youth chief post saying that their individual records have not inspired hope.

Blogging on his website www.razaleigh.com, Tueasday (24 Feb), Ku Li as he is popularly known pointed out that watching the TV debate among the three contenders – Khairy Jamaluddin, Dr Mohamad Khir Toyo and Mukhriz Mahathir, “ None of them has presented a consistent and principled orientation towards reform. Some views expressed in that debate actually called for reversion to bad old form rather than for reform. If the party continues on its present recourse, the question would be moot.”

“ Do you think these representatives of the future leadership are likely to embrace any necessary change?”

He said what happened in Perak recently has all the appearance of a desperate and ill-conceived grab for power, with constitutional consequences that are still being played out.

“Barisan Nasional’s loss of popular support is the real issue, so our task must be to regain support,” he said.

“We really have lost support. March 8 was not a freak result. We have had two by-election losses, both of which were exacerbated by our own members abstaining, or voting for the Oppostion, to have that message drummed into the party leadership.”

“Victory would be to regain that support, and to translate those gains constitutionally into a stronger presence in the government. It would mean coming to terms with the true causes for our loss of support, and addressing those causes with real reform. Yet our leadership has done nothing of the kind over the last year. Instead we celebrate ‘victories’ achieved by tricks and shortcuts liable to lose us even more ground with the Malaysian electorate.”

He warned these moves would harm the long-term prospects of Umno, and especially those of Barisan Nasional. However, he said, they may serve candidates trying to secure their standing within the party in view of upcoming party elections.

“Weak leaders will pass off pyrrhic victories for the real thing, rally party members in the opposite direction from reform, and march them farther from the expectations and values of the Malaysian electorate,” Razaleign said.

“No party can survive long with leaders who are so ready to sacrifice its viability for short-term and short-sighted political interests.”

He also called for a return to consensual leadership saying this is the value proposition. “If you will. If we lose this, we might as well close shop.”

“The negotiated power-sharing model that BN practised successfully in the past requires a genuine partnership among the leaders of the various parties. It takes far more strength and ability to negotiate a consensus than to carry decisions by numerical dominance alone, “he said.

“As the dominant partner of this coalition, Umno has a special responsibility of leadership in this process. It means we pick leaders with the ability and moral authority to mediate consensus and hold a moderate, pragmatic centre while maintaining an ethnic support base. This is something that cannot be done by weak or tainted leaders.”

The consensus building mode of government, he said, requires leadership formed in a tradition in which the skills and relationships needed to govern in this manner are consciously handed on. But the party succession is now dominated by ethnic champions or party warlords with little else to qualify them to govern a plural society with a sophisticated, trade-oriented economy, he added.

“There is also a structural reason for the incipient breakdown of our consensual model. For the model to work, each of the major ethnic parties must credibly and reliably represent its ethnic base. This is no longer the case. MIC, MCA, and now possibly UMNO, have each lost the majority support of the ethnic communities they claim to represent. The very raison d’etre of the model, and perhaps even of these parties, is at stake.”

Nevertheless, he pointed out, there is still the need for this model of consensus-based government, helmed by a Malay leadership imbued with a sense of duty to Malaysia in all its plurality, East and West. The country still needs capable, centrist leaders who are also real leaders of the Malay and Muslim community, able to anchor and partner a multiracial and multi-religious consensus for a progressive country.

“At the outset this means a solid commitment to the rule of law which alone guarantees our form of government by constitutional monarchy and the rights and freedoms of all Malaysians. Umno is failing to provide this leadership but this does not mean we don’t still need it, and need it desperately,” he concluded.

DISCREPENCIES IN PNSB’S PURCHASE OF SAUDI APARTMENT

SHAH ALAM: In order to promote efficiency in the administration and management of the state government’s subsidiaries, the Menteri Besar Incorporated (MBI) has appointed advisors to assist in enhancing the subsidiaries’ performance. One of the areas covered by the advisors is the evaluation of expenses which an important exercise given the current economic downturn.

One of MBI’s concerns is the delay in finalizing the 2007 financial accounts of Permodalan Negeri Selangor Berhad (PNSB). It has come to the attention of the current board of directors that there were discrepancies in the purchase of properties of “Al Marwa Tower Makkah, Saudi Arabia” – an issue which was raised by External Auditors.

According to the PNSB Directors Circular Resolution dated 14 September 2007, PNSB had approved for the purchase of five units of properties amounting to RM8,352,427.66. However, records showed that PNSB had between September 17, 2007 and September 19, 2007 transferred RM25,603,545 to Saudi Arabia for 12 units of properties. Between September 25, 2007 and October 3, 2007 PNSB received cheques amounting to RM17,251,092 from an individual – said to be for the purchase of seven units from PNSB at the price PNSB had paid for. No official receipt was issued to acknowledge it.

Subsequently, in 2008 it has come to the attention of Board of Directors that PNSB prepared and signed four cheques amounting to RM8,000,205.20 to an individual. The individual is the same person who had earlier handed over cheques to PNSB amounting to RM17,251,032 stated above.

However, three of the four cheques prepared and signed by authorized signatories were then cancelled. The fourth cheque amounting RM2 million was released and banked in into the account of the individual. PNSB then arranged with the bank to stop payment. Between the date of the acquisition of the additional seven units making a total of 12 units and the disposal of the seven units leaving five units in the hand of PNSB, there was no Board of Directors Meeting or Board of Directors Circular Resolution for the transaction. Up to the point of issuance and cancellation of cheques to the individual, no Board minutes or circular resolution were made.

It should be noted that the acquisition was made in the name of the then PNSB Chairman Dato Sri Dr. Khir Toyo as Saudi requirement that properties within the Mecca must be in the name of Muslim individuals. At the Board of Directors meeting on December 2007 Dr Khir disclosed the facts the properties are in his name but assured that he will not be making any claim over the property. However, there was no mention of the exact number of units held by him.

The above actions are certainly puzzling. Why did PNSB paid more than RM25 million when the board only approved about RM8 million for five units? Why did it then accept about RM17 million – said to be for the sale of the seven units? Why did it then attempt to re-purchase the units it had sold off? Menteri Besar Tan Sri Abdul Khalid Ibrahim, who is the chairman of MBI, intends to find the answers to the above questions and will not hesitate to take strong action should there be any criminality involved.

Krisis perlembagaan di Perak mulai memihak Pakatan Rakyat

KOTA BHARU, 24 Feb (Hrkh) - Kemelut yang berlaku di Perak sekarang sudah menghampiri krisis perlembagaan apabila Menteri Besar kudeta, Dato' Zambry Abdul Kadir terpaksa mencari pakar undang-undang bagi merujuk kes tersebut.

Pengarah Jabatan Pilihan Raya PAS Kelantan, Haji Abdul Fatah Haron berkata, kemelut politik Perak kini hampir memihak kepada Pakatan Rakyat di bawah pimpinan Dato' Seri Ir Mohamad Nizar Jamaluddin, apabila dilihat pemimpin Umno semakin kalut.

"Mereka mengambil jalan terakhir meminta nasihat daripada pakar perundangan di luar negara khususnya England biar pun cuba dinafikan mereka.

"Ini menampakkan perkembangan mutakhir di mana Umno telah merasai krisis perlembagaan yang berlaku kini memihak kepada Pakatan Rakyat," katanya kepada pemberita di lobi Dewan Undangan Negeri, di Kota Darulnaim hari ini.

Beliau yang juga Adun Bukit Tuku berkata, tindakan Umno mencari pakar undang-undang di luar negara menggambarkan keraguan mereka menyelesaikan kemelut sekarang.

Menurutnya Umno mulai meragui kesahihan Undang-Undang Tubuh Negeri Perak apabila krisis terus berlanjutan sehingga sekarang yang mungkin tidak dijangka oleh mereka.

Hari ini akhbar melaporkan Zambry melantik peguam sebagai kaedah terbaik berdepan dengan Pakatan yang kini menggunakan saluran undang-undang untuk berkuasa semula.

Akhbar berbahasa Inggeris semalam juga melaporkan beberapa peguam dan seorang Adun BN di Perak berlepas ke London malam semalam.

Sementara itu seorang pegawai kerajaan berkata, usaha kerajaan kudeta di Perak menukar Speaker V Sivakumar gagal kerana Speaker tak mungkin membenarkan usul tidak percaya terhadapnya.

No more bull please, PKR tells MACC

SHAH ALAM, Feb 25 — PKR Youth today declared war on former Selangor Menteri Besar Khir Toyo and reminded the Malaysian Anti Corruption Commission (MACC) of the 20 corruption reports it had lodged against him.

To prove its point, PKR Youth paraded a bull on the back of a red Isuzu truck and tried to present it to the MACC.

Police, however, denied entry to the bull.

But several key youth leaders made their way to the MACC office to deliver their memorandum and give their statements.

“The MACC does not mean the Malaysian Commission for cows and cars,” said Shamsul Iskandar Mohd Akin, the PKR Youth chief for Malaysia.

“Why did they investigate the issue of 46 cows but sidelined all other reports?” he added, referring to allegations that Selangor Menteri Besar Tan Sri Khalid Ibrahim had used state funds to purchase cattle for mosques in his constituency and to pay for the maintenance of his personal car.

Apart from the 20 reports, PKR Youth said Khir Toyo is alleged to have bought a few luxury apartments in Saudi Arabia using state funds.

“When we declassify documents, we are going to file many corruption reports (against Khir),” said Shamsul.

Pakatan Rakyat has alleged that the MACC has been quick to investigate and issue statements regarding reports lodged against them but not those against the Barisan Nasional (BN).

“We want to tell the MACC not to be led by the nose like a cow,” said Khairul Anuar Ahmad Zainudin, PKR Youth chief for Selangor.

He added that the bull was given to PKR by a loyal supporter and had the necessary veterinary documents for it to be brought out in public.

Two opposition reps claim they were offered millions to cross over .

Two opposition assemblymen today lodged reports with the Malaysian Anti-Corruption Commission claiming they had been offered cash if they were to declare themselves independent or join Barisan Nasional.

DAP's Keshvinder Singh (Malim Nawar) said he was offered RM20 million while Abdul Yunus Jamsari of Parti Keadilan Rakyat (Kuala Kurau) said the amount offered to him was between RM3 million and RM8 million.

Speaking to reporters outside the MACC office here, Keshvinder said the offer was made by several agents who claimed they represented Deputy Prime Minister Datuk Seri Najib Razak who is also Perak Umno liaison chairman.

One of them was a local Chinese newspaper journalist, he said.

He said that other offers were that if he were to join the MIC, he would be appointed Perak MIC chairman and state executive councillor. The offer to serve as a state executive councillor came after BN took over the state government, he said.

"I urge Najib to come forward with a statement because this action obviously shows this country's government is too corrupt and very desperate," he said.

Yunus said that besides cash, he had also been offered a logging concession he if were to leave PKR.

The offers were made by several businessmen who claimed they represented the Perak government leadership, he said.

Accompanying the duo at the MACC office were seven other opposition assemblymen. They were Ramli Tusin (Semanggol), A. Sivasubramaniam (Buntong), Chan Ming Kai (Simpang Pulai), Chang Lih Kang (Teja), Sum Cheok Leng (Bercham), Leong Mee Meng (Jalong) and Khalil Idham Lim Abdullah (Titi Serong).

MB vs MB case: Judge recuses himself

Judicial Commissioner Mohamad Ariff Yusof today decided to step down from hearing the case of Datuk Mohammad Nizar Jamaluddin challenging the legitimacy of Datuk Zambry Abdul Kadir as the Perak menteri besar.

Ariff said he was doing so because "justice must be manifestly seen to be done." He noted that there were other qualified judges to hear the case.

Alternatively, Nizar could choose to refer the case straight to the Federal Court for a more immediate and final decision.

"In overall circumstances, I find it best that I recuse myself from hearing this case," he concluded.

One of Nizar's nine lawyers, Ranjit Singh, said they would wait to see who will be the next judge from the Appellate and Special Powers decision of the KL High Court assigned the case before making a decision.

Nizar, who was in court for the hearing, said he would abide by the court's decision. "We have the confidence if the application is heard before another judge," he told reporters outside the courtroom.

"The legal battle has begun. We are confident of winning," he added.

Sultan sympathises with Eli but won't interfere

The Sultan of Selangor is unhappy that Eli Wong’s privacy has been violated but he does not want to be involved in a decision about her political career.

The sultan’s private secretary, Datuk Mohamad Munir Bani, said this was expressed by the sultan when Menteri Besar Tan Sri Abdul Khalid Ibrahim had an audience with the ruler today to brief him on the political developments in the state and to get his advice on the issue involving Wong, who had offered to resign because of the pictures.

“The sultan had commanded me to inform that his royal highness could not offer any guidance or advice to the menteri besar in the matter related to Wong as it was still under police investigation and that it involved her political position.

“It is his stance as the Sultan of Selangor to be above politics,” Mohamad Munir said in a statement sent to Bernama here today.

Following is the full statement by the Sultan of Selangor, Sultan Sharafuddin Idris Shah, over the controversy involving Bukit Lanjan state assemblyman Elizabeth Wong.

I am pleased to inform that Yang Amat Berhormat Tan Sri Dato’ Abdul Khalid Bin Ibrahim, the Dato’ Menteri Besar Selangor has sought an audience with His Royal Highness, The Sultan of Selangor, on Wednesday, 25th February 2009 and duly informed His Royal Highness on the political development and the issue which involved Yang Berhormat Elizabeth Wong Keat Ping, the Selangor State Assemblyman for Bukit Lanjan who is also the State Selangor Exco Member.

His Royal Highness, The Sultan of Selangor, has commanded me to inform that His Royal Highness could not offer any guidance or advice to the Yang Berhormat Dato’ Menteri Besar of Selangor in the matter related to the issue of Yang Berhormat Elizabeth Wong Keat Ping as it was still under police investigation and it involved her political position. Wong, 37, tendered her resignation to Khalid on Feb 17.

She is now believed to be abroad and has reiterated her stand to resign as state assemblyman and also state executive councillor despite advice from the Parti Keadilan Rakyat (PKR) leadership to reconsider her decision while on leave.

Wong, who is Wanita PKR information chief, won the Bukit Lanjan state seat in the March 2008 general election after defeating Barisan Nasional's Datin Paduka Yong Dai Ying with a 5,155-votes majority.

Court dismisses Anwar objection in sodomy II

— The Kuala Lumpur High Court today dismissed Datuk Seri Anwar Ibrahim’s objection to the prosecution’s application not to transfer the sodomy case to the High Court. The prosecution’s application was an appeal for the case to be heard in the Sessions Court.

Justice Mohamad Zabidin in allowing the application by the prosecution said the preliminary objection is premature and the High Court has wide revisionary powers.

The prosecution team is led by Solicitor-General Datuk Mohd Yusof Zainal Abiden.

In November, Sessions Court Judge SM Komathy refused to transfer the case to the High Court after the defence team led by Sulaiman Abdullah challenged the validity of the certificate of transfer signed by the Attorney-General.

Earlier the defence argued that the decision for the case to remain at the Session Courts does not amount to miscarriage of justice as the charge against Anwar is still pending and the prosecution is still free to proceed with the trial.

It added that the prosecution has to show that “a substantial failure or miscarriage of justice has occurred which has caused undeserved hardship”, for the High Court to invoke its power in revising the earlier decision.

“It is our humble submission that no injustice has been caused to the prosecution by the Sessions Court’s refusal to transfer the case, and no injustice has been caused to the prosecution’s right to pursue its case,” said Sulaiman in his submission.

The prosecution said that the Sessions Court judge had committed an error.

“The learned Sessions Court judge did not stipulate under which provisions of the law the decision was based. The order of the learned Sessions Court judge was plainly wrong and illegal which would warrant the intervention of this honourable court under its revisionary powers,” said Yusof.

He also argued that the High Court has a wide and extensive revisionary powers.

Anwar withdraws application to disqualify prosecutor

Opposition Leader Anwar Ibrahim withdrew his application to disqualify chief prosecutor Mohd Yusof Zainal Abiden from acting in his sodomy trial, after the latter submitted an affidavit saying he had never seen certain investigation papers that could mar his handling of the case.

Anwar’s lawyer Sulaiman Abdullah had initially feared Mohd Yusof might be involved in his client’s “black eye” case that took place 11 years ago.

Sulaiman had also wanted the court to disqualify Mohd Yusof from handling the government’s appeal against the Sessions Court’s decision to hear the sodomy trial, instead of transferring it to the Hight Court as demanded by the prosecution.

With Sulaiman’s withdrawal of the applications this morning, the High Court will proceeded to hear the appeal.

Anwar, who is also Permatang Pauh MP, was charged with sodomising his former aide, Mohd Saiful Bukhari Azlan, 23, at the Desa Damansara condominium on June 26, 2008. If convicted, he faces up to 20 years in jail.

Anwar is currently free on a personal bond of RM20,000.

Khalid alleges BN paid RM17.5m in questionable Mecca deal

SHAH ALAM, Feb 25 — The Barisan Nasional state government made unauthorised investments for properties in Mecca, Saudi Arabia worth RM17.5 million in 2007, the Selangor menteri besar’s office has revealed.

The acquisitions were made through the state investment agency Permodalan Negeri Selangor Berhad (PNSB) without the approval of the board of directors, according to a statement from the office of Pakatan Rakyat MB Tan Sri Khalid Ibrahim released late last night.

The disclosure of the unauthorised acquisitions come a day after Khalid said two top officials from PNSB were ordered to go on a month’s paid leave to facilitate investigations into “irregularities and weaknesses” in the company’s financial accounts.

They are chief executive Datin Khairiyah Abu Hassan and finance manager Nora Azmin Radzuan, who is also Selangor Puteri Umno chief.

Khalid’s disclosure of alleged improprieties appear targeted at former BN MB Datuk Dr Khir Toyo, whose recent complaints of abuse of power against him have resulted in the current state leader facing charges from the Malaysian Anti-Corruption Commission.

According to Khalid’s office, the PNSB board had in 2007 only approved the purchase of five properties in Al Marwa Tower, an apartment complex built by the BinLadin group near the Kaaba, for RM8.3 million.

However, PNSB eventually acquired a total of 12 properties for RM25.6 million.

In what was described as “puzzling” by the MB’s office, PNSB then almost immediately flipped seven of the properties to an individual for RM17.2 million. The individual was not named by Khalid’s office.

The MB’s office then noted that some time in 2008, PNSB prepared four cheques for RM8 million in the name of the same individual who had earlier paid the RM17.2 million for the seven properties in 2007.

“However, three of the four cheques prepared and signed by authorised signatories were then cancelled.

“The fourth cheque amounting to RM2 million was released and banked into the account of the individual. PNSB then arranged with the bank to stop payment,” the MB’s office said.

Khalid’s office said external advisors have now been appointed to assist in evaluating expenses of state agencies, including PNSB.

External auditors have also raised a red flag over the purchase of the Al Marwa Towers properties.

“The above actions are certainly puzzling. Why did PNSB pay more than RM25 million when the board only approved about RM8 million for five units?

“Why did it then accept about RM17 million said to be for the sale of the seven units? Why did it then attempt to re-purchase the units it had sold off?” the statement said.

The MB’s office said Khalid intends to take strong action should any criminal act be involved.

Elsewhere Lebanese Elections : EU Ready to Monitor

The European Union's commissioner for external relations, Benita Ferrero-Waldner, announced Tuesday that the EU was ready to send observers to Lebanon to monitor the upcoming parliamentary elections.
The EU is ready to send a delegation to monitor the June 7 parliamentary elections, Ferrero-Waldner told a press conference after meeting Premier Fouad Saniora at the Grand Serail.

"The biggest challenge is the parliamentary elections. We are helping the Lebanese government and are ready to send a delegation to monitor the elections," she said.

Ferrero-Waldner hoped the intra-Lebanese dialogue would lead to reconciliation. She also said that Lebanese authorities have agreed to an EU committee to ensure all preparations are made prior to the elections.

The commissioner also met with President Michel Sleiman, Foreign Minister Fawzi Salloukh and Interior Minister Ziad Baroud.

Pilihanraya kecil Dewan Undangan Negeri (DUN) Sarawak kawasan Batang Ai perlu diadakan berikutan kematian penyandangnya Datuk Dublin Unting hari ini.

Pengerusi Suruhanjaya Pilihan Raya (SPR) Tan Sri Abdul Aziz Mohd Yusof berkata ini kerana penggal DUN itu baru berusia lebih dua tahun dan mengikut Perlembagaan Negeri Sarawak, penggal akhir DUN itu ialah pada Julai 2011.

Guan Eng to sue Utusan

– Penang Chief Minister Lim Guan Eng is planning to sue Utusan Malaysia and Penang Islamic Council chairman Shabudin Yahya for alleging he had formed an Interfaith Council which was an insult to the status of Islam as the country's official religion.

Lim Guan Eng, who is also DAP secretary-general, rejected claims made by Shabudin that he had established the Interfaith Council.

“I will order my lawyer to sue Utusan. I have lost my patience because yesterday there was also a false report made. As a leader in the Penang state government, we support the status of Islam as the official religion of the state of Penang.”

In the article, Shabudin claimed that Penang had established an Interfaith Council.

Shabudin, who is also Permatang Berangan assemblyman told Utusan Malaysia that “this is something scary because Islam is seen as having the same status as Buddhism which was founded by a man named Gautama Buddha. It is also being seen in the same light as Christianity, Taoism and Bahai.”

“I feel I should not say anymore because this case will be brought to court. I would like to state that there isn’t any interfaith council,” said Lim.

“Today they want to bring up the issue of religion and bring the feeling of hatred among all Malaysians and races.

“I think this is too much, we will see each other in court. I would like to know where they got the information that the state government has created an Interfaith Council,” he added.

Zambry denies Umno engaging QC

– Datuk Dr Zambry Abdul Kadir denied today Umno was seeking the services of a Queen’s Counsel in Britain to break the constitutional deadlock in Perak.

“No one has gone to London and we are not engaging any QCs,” he said.

The Perak Menteri Besar, from Barisan National (BN), was speaking to the press after attending the official launch of the Malaysian Anti-Corruption Commission (MCAC) at the Putra World Trade Centre.

On a separate issue, Zambry said he had identified several suitable Umno candidates for the Bukit Gantang by-elections which will be held on April 7.

The Parliamentary seat became vacant with the death of Pas Member of Parliament Roslan Shaharum, 50, who died on Feb 9.

Zambry said Bukit Gantang was previously contested by Umno and the candidate must be acceptable to locals.

He said the list of potential candidates would soon be submitted to the prime minister.

“God willing, we will win,” he replied when asked about BN chances of taking the seat in the upcoming by-election.

He also said that he was not in a hurry to move into the official residence of the Perak Menteri Besar, which has been vacated by Datuk Seri Mohammad Nizar Jamaluddin.

“That is a small issue and I am more eager to get on with my duties and responsibilities.”

Sarawak by-election after Batang Ai rep dies

Batang Ai assemblyman Datuk Dublin Unting Ingkot died at 1.25am at the Normah Medical Specialist Centre here after suffering from a stroke.Unting, 55, who was the Parti Rakyat Sarawak (PRS) vice-president and Sports and Agriculture assistant minister, is survived by his wife, Datin Froline Moriah Demies Impoi, two sons and a daughter.

He had been hospitalised for the past nine months after falling into a coma following a massive stroke in May last year while being interviewed by a Radio Television Malaysia (RTM) radio channel in his capacity as the Chef de Mission for the Sarawak contingent to the Malaysian Games (Sukma).

PRS secretary-general Wilfred Nissom told Bernama that he paid him a visit last night when it was learnt that his condition had taken a turn for the worse.Unting’s will be bought back to his residence at Jalan Kampung Stutong here later today.In the last state election held in May 2006, Unting won the predominantly Iban seat after defeating Nicholas Bawin Anggat of the Sarawak National Party (SNAP) with a 806-vote majority.

He first won the Batang Ai seat in 1991 under the Parti Bansa Dayak Sarawak (PBDS) ticket, which was then in opposition at the state level in a straight fight with Mikai Mandau from the Barisan Nasional (BN).

In the subsequent state elections held in 1996 and 2001, he retained the seat on BN-PBDS ticket and later joined PRS following the deregistration of PBDS due to an internal leadership crisis in 2004.

PRS president Datuk Seri Dr James Masing praised Unting as a dedicated assemblyman who was committed to improving the socio-economic standard of his constituency and the state as a whole."He is a person who does not hold any grudges or ill feeling against anybody as far as I know," he told Bernama."On behalf of the party I offer my condolences to his family. His dedicated services to the party, constituency and state will be forever remembered," he added.

Batang Ai state assemblyman Datuk Dublin Unting Ingkot died shortly after 1am this morning. He was 53.

The Sarawak Assistant Minister for Sports and Agriculture been ill following a stroke last year.

His demise paves the way for a by-election in the state that Pakatan Rakyat has designated as the next front in its struggle against Barisan Nasional.
