Karpal: Suspensions must be endorsed by state assembly

The decision of the Perak state assembly's committee of special privileges to suspend Datuk Zambry Abdul Kadir and his six executive councillors must be endorsed by the state assembly.

DAP stalwart Karpal Singh said Perak Speaker V. Sivakumar must convene a sitting of the assembly to debate the decision of the committee and put it to a vote.

He said the Perak constitution provides that when the assembly is not sitting, the speaker can refer complaints to the committee of privileges which he heads.

If he finds a prima facie case, any findings or decisions must be reported to the assembly.

"It's my view that this means the speaker must refer the matter to the state assembly for debate and endorsement."

The Gelugor MP said he faced a similar action in 2004 for being accused of misleading Parliament by saying that MPs must raise their right hand when taking their oath of office and lost both his allowances and privileges during the suspension.

"The committee of privileges made a decision to suspend me for six months and this was brought before the House where it was debated and the decision was confirmed."

Karpal Singh said he was allowed to participate in the debate and similarly Zambry and his executive council should be afforded the same rights if the matter is brought before the Perak assembly.

Karpal added that the resignation of the three former Pakatan Rakyat state assemblymen who have chosen to become independents should also be debated and resolved in the assembly.

The Perak constitution provides that when there is doubt over the status of the assemblymen the House should have the prerogative to decide on the matter.

However Karpal Singh said in order to break the deadlock, the Perak Ruler should reverse his own decision and dissolve the state assembly and call for fresh elections.

"Most people in Perak want fresh polls and there was nothing to stop the Ruler from changing his decision."
