The order, which was extracted from the Ipoh high court today, reads: “It is hereby ordered that the 1st Defendent, YB Encik Sivakumar A/L Varatharaju Naidu is restraint from convening any unlawful meetings purporting it to be a meeting of the Perak State Legislative Assembly.”
It concludes with “If you, the within-named YB Encik Sivakumar A/L Varatharaju Naidu disobey this Order, you will be liable to process of execution for the purpose of compelling you to obey the same.”
The order, dated 3rd of March 2009, was served by Zambry’s lawyer, Faizul Hilmy Ahmad Zamri and received by Sivakumar’s political secretary A Wasu.
The speaker was away on other engagements says Wasu.
The restraining order was granted yesterday by judicial commissioner Ridwan Ibrahim under section 44 of the Specific Relief Act.
Faizul had first served the order to the state legal advisors office, located downstairs of the state secretariat building at 3.20 pm when he found Sivakumar’s office closed.
The state legal advisor was appointed as counsel for the speaker yesterday after Zambry’s lawyers objected to the use of private lawyers.
Questions over conflict of interest have risen as the state legal advisor is also representing Zambry in a lawsuit filed against him by Datuk Seri Nizar Jamaluddin, the ousted Menteri Besar of the Pakatan Rakyat government.
Faizul however, defended the state legal advisor’s office. “The deputy state legal advisor made lengthy submissions yesterday and did not just concede the case,” he told reporters at Sivakumar’s office.
